Always one of my most favorite and inspiring sessions at the ICMA conference. I love sharing these moments with my fellow Massachusetts power-women!! A quote from one of the esteemed panelists Peggy Merriss:“Trust is an investment, not an entitlement”. Thanks to all those at SheLeadsGov four your work and in particular, Laura Savage at ICMA.

“One of the strengths of The Registry bringing in an interim is that the interim can get things done that need to be done. Usually, there are difficult decisions that have to be made, that probably should have been made and were not. The interim can make those tough decisions and pave the way for the permanent person when appointed.”To learn more about how Registry interims impact institutions, check out our latest video featuring one of our Senior Consultants, Dr. Ian Newbould.

Sisvel President Mattia Fogliacco moderated a plenary today at #IPBCGlobal entitled Europe's Tectonic Shift. The session's panellists were: Lyse Brillouet of Orange; Naoise Gaffney of GH Research; Dr. Sophie Pasquier of Philips; and Richard Vary of Bird & Bird. It's a common criticism of these kinds of session - and a fair one to an extent - that it's basically all about preaching to the converted. Everyone on the panel broadly agrees and so does everyone in the audience. Nothing is achieved. But here's the thing: these panellists know what they are talking about; they are in the market, they understand how it works; they can identify bottlenecks, flaws and problems, as well as opportunities. When they say there are very serious issues with the SEP licensing regulation, for example, the smart thing is to listen to them rather than to shut them out, as has happened up to now. These people share the Commission's objectives - transparency, efficiency and predictability in SEP licensing - but they are deeply concerned about the legislation's proposed solutions. SMEs are likely to be exposed to more, not lower, overheads and costs as a result of it; there will probably be suits at the CJEU about denial of property rights and access to justice; the ability to find agile, flexible market solutions to specific challenges is likely to be hindered; extended uncertainty that hampers dealmaking is almost certain; the EUIPO could well be overextended; and so on. If you fear all these things and more are likely to be the result of implementing the regulation in its current form, you are duty bound to scream it from the rooftops relentlessly in the hope that at some point someone who matters will finally start to hear. Yes, it's frustrating that a lot of industry events do tend to be repetitive, but the alternative is silence. And silence is a dereliction of duty. Richard Vary put it best. Europe is at a fork in the road, he said. The choice is either to follow a path in which a tried and tested system is interpreted and improved by the UPC, so ensuring ongoing European leadership in the FRAND/SEP world; or to take the other route with an unamended regulation, in which case the baton of leadership will pass to the likes of India, China and even the UK. The Commission and EU member states need to confront that reality. It cannot be wished away.

Inclusive Development International's Natalie Bugalski was in Dublin last week, speaking at the launch of the Dublin Declaration on Fair and Equitable Land Access (FELA). A work in progress, the Dublin Declaration, or FELA 1.0, proposes a new approach to negotiating land use and access when development projects threaten to displace local communities—one that treats affected people as partners rather than externalities. At the launch, Natalie spoke to issues of accountability and remedy, underscoring that harms caused by displacement need to be avoided in the first place, by ensuring that communities have a genuine role in decision-making, including about whether and on what terms a project proceeds. She proposed that intensive community-company mediations, typically only pursued as part of efforts to repair harm after its done, should be used at the outset to reach agreement on the terms of land access before projects begin. And she stressed that these community-company agreements must be legally binding and enforceable by communities themselves, either through courts or arbitration, so that communities are in a position to hold project developers directly accountable if and when harms occur. Launching the FELA Declaration 1.0 is just a first step—we are looking forward to the input of civil society and communities to formulate a clear new approach demanding that project developers, including mining companies that aim to supply metals and minerals for the clean energy transition, treat communities with respect and move forward with projects on their land only with their agreement. As Natalie told the audience of impact assessors in Dublin, “there is no doubt that a fundamentally different approach that centers the rights of affected communities is urgently needed.” https://lnkd.in/eqR2r3hh

The 11th r3.0 International (online) Conference 'Tipping Points on Tipping Points - Building Necessary Collapse Resilience' on September 10/11 has four main themes, each with extraordinary speakers. The Fourth Session is focused on our signature issue of Thresholds & Allocations. Thresholds approximate where systems transgress their carrying capacities and so enter the danger zone where tipping points can be crossed at any moment, triggering systemic collapses. As Mark McElroy first established in his 2008 dissertation, carrying capacity transgressions apply not only to ecological system overshoot, but also social system undershoot (hence our use of the term "caring capacity".) Allocations require all actors to take accountability for their fair share responsibility of respecting systemic carrying capacities. Mahlet Getachew will round out the Session by previewing the future direction of thresholds & allocations by presenting on the Business Standards for 21st Century Leadership that the Corporate Racial Equity Alliance is developing (currently in a public consultation draft), which integrate key elements of thresholds & allocations such as duties & obligations and context-based materiality.Get your ticket at https://lnkd.in/e8QSWjVX and be with us for all 4 conference topics, discussed on September 10/11 online.
